Project Purpose:
Bluepoint Wind, LLC (Bluepoint Wind), the lessee of Renewable Energy Lease Area OCS-A 0537 (Lease Area), proposes to construct and operate an offshore wind project in the western portion of the Lease Area with associated offshore and onshore facilities (the Bluepoint Wind 1 Project or the Project). The purpose of the Bluepoint Wind 1 Project is to generate and deliver renewable energy from offshore wind to help meet federal and state renewable energy and climate goals by the early 2030s. The United States (U.S.), New York, and New Jersey have ambitious renewable energy goals for the purpose of diversifying electricity supplies, increasing electricity reliability, and reducing greenhouse gas emissions. Presidential Executive Orders 14008 and 14057 demonstrate the need for offshore wind energy. Executive Order 14008, Tackling the Climate Crisis at Home and Abroad (2021), directed the Secretary of the Interior to identify steps that can be taken to double renewable energy production from offshore wind by 2030. The Executive Order also includes goals to achieve a carbon pollution-free electricity sector no later than 2035 and achieve net-zero emissions, economy-wide, by no later than 2050. Executive Order 14057, Catalyzing Clean Energy Industries and Jobs Through Federal Sustainability (2021), required that federal facilities be powered with 100 percent carbon pollution-free electricity by 2030 while considering environmental justice and equity initiatives when making decisions related to federal facilities, fleets, and operations. The Project will deliver power to either New York or New Jersey, both of which have enacted mandates to reduce greenhouse gas emissions through the procurement of offshore wind capacity. New York’s Climate Leadership and Community Protection Act targets a 40 percent reduction in GHG emissions by 2030 and an 85 percent reduction by 2050 when compared to 1990 levels. The New York Public Service Commission has ordered that 9 GW of new electric generation be built to achieve that target by 2035. New Jersey’s Global Warming Response Act of 2007, as amended in 2019, mandates a reduction in state GHG emissions to 80 percent below 2006 levels by 2050. New Jersey Executive Order 307 demonstrates that the state’s intends to hit this target by procuring 11 GW of offshore wind energy capacity by 2040. To meet these ambitious targets, New York and New Jersey have initiated competitive solicitations for the procurement of offshore wind generation. Project Description:
Bluepoint Wind acquired Lease Area OCS-A 0537 in February 2022 following the Bureau of Ocean Energy Management (BOEM) competitive renewable energy lease auction (Atlantic Wind Lease Sale 8). The Lease Area, consisting of 71,522 acres (289 square kilometers [km2]), is located in the New York Bight in the Atlantic Ocean. Bluepoint Wind plans to develop the Project in the western portion of the Lease Area and produce renewable energy for the states of New Jersey and/or New York. The Bluepoint Wind 1 Wind Development Area consists of the western 42,429 acres (171.7 km2) of the Lease Area. The Wind Development Area is located approximately 43.7 statute miles (mi) (38 nautical miles [nm], 70.4 kilometers [km]) off the New York coast and approximately 61 mi (53 nm, 98 km) off the New Jersey coast. The Project will include up to 102 wind turbine generators (WTGs) with an anticipated capacity of up to 1.2 gigawatts. Potential export cable routes run to New York and New Jersey. Bluepoint Wind has completed extensive surveys of environmental conditions, cultural and historic resources since obtaining the Lease Area. Environmental and cultural resources within the Project Area are described in the Construction and Operations Plan and topic specific technical analyses (Marine Archaeological Resource Assessment; Essential Fish Habitat Assessment; Benthic Habitat Assessment; Seascape, Landscape, Visual Impact Assessment; Historic Resources Visual Effects Assessment, etc.) will be further analyzed during the National Environmental Policy Act (NEPA) process and the related consultations undertaken by BOEM. ------------------------------------------------------------------------------ ....
Technical and Financial Ability:
Bluepoint Wind, LLC is a 50/50 partnership between Ocean Winds (OW) and Global Infrastructure Partners (GIP). Together, these companies have a successful track record of over 50 years of experience in development, financing, construction, and operation of renewables projects, including more than 15 years of experience with offshore wind projects. Summary of Financing, Reviews and Authorizations:
The Project is subject to NEPA review and requires several federal authorizations or permits. BOEM will be the lead federal agency for the Project and will coordinate with other federal environmental resource agencies participating in consultations and issuing permits for the Project. Under NEPA, BOEM must review the Project for compliance with other federal laws, including but not limited to the Endangered Species Act, the Bald and Golden Eagle Protection Act, the Migratory Bird Treaty Act, the Marine Mammal Protection Act, the Magnuson-Stevens Fishery Conservation and Management Act, and the National Historic Preservation Act (NHPA). BOEM will consult with agencies responsible for implementing these laws, including but not limited to, the National Oceanic and Atmospheric Administration National Marine Fisheries Service (NOAA Fisheries) and the U.S. Fish and Wildlife Service (USFWS), and issue an Environmental Impact Statement (EIS) on the Project. The Project will also require other federal permits for specific activities. Other anticipated federal permits the Project will require include, but are not limited to: an Individual Permit from the U.S. Army Corps of Engineers (USACE) under, Section 404 of the U.S. Clean Water Act and Sections 10 and 14 (also known as Section 408) of the Rivers and Harbors Act; a Letter of Authorization under the Marine Mammal Protection Act from NOAA Fisheries; and an Outer Continental Shelf Air Permit from the U.S. Environmental Protection Agency (EPA). The federal agencies issuing these permits may request to be cooperating agencies under BOEM’s NEPA process. For example, an Individual Permit issued by USACE is also considered a federal action and requires NEPA review. Therefore, the USACE could request to be a cooperating agency under BOEM’s NEPA process. BOEM will also coordinate and consult with many other agencies, including the EPA, the United States Coast Guard (USCG), and the United States Department of Defense, as well as the States of New Jersey and/or New York under the Coastal Zone Management Act of 1972 (CZMA). In addition to being reviewed by BOEM under NEPA and other federal agencies, portions of the Project onshore and within 3 nm (5.6 km) of shore are under jurisdiction of the states of New York and/or New Jersey and are subject to applicable state and local regulations and review. ------------------------------------------------------------------------------ ....
Project Assessment:
The Bluepoint Wind 1 Project meets the definition of a covered project under 42 U.S.C. §4370m(6)(A)(i) on the merit that it (1) is subject to NEPA, (2) requires a total investment of more than $200,000,000, and (3) does not qualify for abbreviated authorization or environmental review processes under any applicable law. The Project also meets the definition of a covered project under 42 U.S.C. §4370m(6)(A)(iv) because it (1) “requires authorization from or environmental review involving more than two federal agencies,” and (2) will require “preparation of an environmental impact statement under NEPA.” ------------------------------------------------------------------------------
